Brazil's ANAC Opens Public Consultation on SAF Emissions Rules Under Fuel of the Future Law

Brazil's National Civil Aviation Authority (ANAC) has opened a public consultation, running until October 1, 2026, on draft regulations for monitoring and complying with sustainable aviation fuel (SAF) emissions rules. The consultation follows Decree No. 13,094 of August 12, 2026, which regulates the ProBioQAV programme and sets operational rules for SAF production, certification, trading and oversight, and for meeting mandatory greenhouse gas reduction targets under the Fuel of the Future Law (Law No. 14,993/2024) for domestic air operators.

Under the draft resolution, the rules apply to any RBAC-certified operator emitting 10,000 tonnes of CO₂ or more in a year; such operators must submit an Emissions Monitoring Plan to ANAC by October 31 of the relevant year and file an annual Emissions Report. To meet the reduction targets in Article 10 of Law No. 14,993/2024, operators must retire SAF Sustainability Certificates (CS-SAF), a book-entry instrument tied to SAF sold in the domestic market under a book-and-claim model. The target starts at 1% on January 1, 2027, rising to 10% by January 1, 2037.

The Decree bars issuance of CBIOs for SAF production to prevent double counting, though operators may still use CBIOs as an alternative compliance mechanism within caps: 5% of the annual target overall, with transitional caps of up to 15% in 2027 and 2028 and up to 10% in 2029. ANAC will oversee compliance, with CS-SAF retirement due by January 31 of the year following the target reference year, while Brazil's ANP and ANAC must issue complementary regulations, including for the National SAF Certification Programme, by December 18, 2026.
